This website is operated by EZ Flash USA. Throughout the site, the terms “we”, “us” and “our” refer to EZ Flash USA. EZ Flash USA offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

By accessing or using any part of the site, you agree to be bound by these Terms of Service including all other policies including but not limited to Returns & Refunds, Shipping, and Support. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

SECTION 5 - PRODUCTS OR SERVICES (if applicable) 

We do not provide any installation instructions. You are expected to have professional skills and equipment to complete the installation. If any instructions are provided they are a courtesy and may not include all details. Any videos linked or posted on this website are for entertainment purposes only. We are not responsible for incorrect installations. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. 


We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. Some items may come packed in hard cases, these cases are considered packing materials and we do not guarantee one box per item. Size and type of box used will be appropriate to the most efficient shipping method.

We do not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected. When purchasing modification kits or any other electrical equipment/components you are expected to have basic knowledge of these systems. We are not responsible for any damage caused from misuse or negligence by the user. If there is an open chargeback on an order we will be unable to assist you directly until it has been resolved with the card company.


We are not responsible for any lost or damaged packages. If you would like full insurance coverage on your order you must purchase Route shipping protection at checkout.


SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. Use of multiple accounts to attempt to bypass one time use discount codes will result in termination of all accounts and any future accounts.


You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Advertising payouts or affiliate payouts happen quarterly or when the payout amount exceeds $200.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

In no case shall EZ Flash USA, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Section 20 - Chargebacks

Any attempt at fraudulent chargebacks will result in prosecution to the full extent of the law. Prosecution will occur in the jurisdiction of the State of Rhode Island. The defendant will be responsible for damages as well as any travel or legal fees. All interactions with the customer before the chargeback will be used as evidence in the case.

Please allow 4-7 business days handling time for your order to be filled. We use USPS First Class Mail, larger orders will be shipped USPS Priority Mail. Please allow 7-10 days for your item to arrive from the time shipped unless you choose an expedited service.


If you have chosen Priority or Priority Mail Express shipping we will try to ship your order as soon as possible but there is no guarantee that it will be shipped out the same or next day.


Shipping times do not include handling times.


Priority Mail Express is the only service with a guaranteed delivery date, if your package is past the expected delivery date please contact us. Weather and holidays may delay shipping. Please see below for a breakdown of shipping options.


If your order contains an item that is available for preorder only, the order will not ship until the preorder item is ready to ship.


If we can not fill your order completely, we will still ship all of the items we can as soon as possible. We will refund and notify you about any unavailability items and will be happy to work with you on purchasing different items.

We are not responsible for lost or stolen parcels or parcels returned to sender due to an incorrect addresses being provided, please make sure your address is correct before completing your purchase.

If your tracking shows your order has been delivered but you have not received it please contact your local Post Office and open a case on the package before contacting us. Generally if there is a delivery scan there is nothing we can do, if you believe your parcel was stolen please contact your local Police.


Mail Services:


First Class Mail: The cheapest and slowest shipping option available for packages under 1lb. This service can take anywhere from 3-10+ business days to arrive.


Priority Mail: This option is required for packages over 1lb. It is slightly faster with an average shipping time of 2-4 business days. Delivery times are not guaranteed.


Priority Mail Express: The fastest shipping option available, generally arriving in 1-2 business days. Delivery times are guaranteed. Please contact us if your delivery is late. 


Economy: This service is the free shipping option that is available for orders over $75. It is the same as First Class Mail, Delivery times are not guaranteed.


Cancel/edit orders: 


If you would like to cancel or edit your order you can do so from your order history on the account page. If you did not make an account at checkout, you can make an account after using the same information used at checkout. Your order will then appear under your order history. You can access your order history when logged in by clicking your name in the top left side of our website. We are unable to manually cancel or edit orders. Orders that have been shipped will not be eligible for editing or cancellation.


Missed Deliveries:


It is your responsibility to make arrangements to receive your package. Generally, if you miss your package’s arrival, the courier will bring it to a nearby post office and leave you with a delivery notice card. Please familiarize yourself with your postal service’s rules and regulations.


If you fail to pick up your package within the allotted window, you have two options:


You can pay for shipping again and we’ll send it back to you.

We can refund your order with the exception of shipping costs and any additional taxes, duties, customs or miscellaneous transportation fees. If it’s been over 30 days, we will also charge a 20% restocking fee.

Please note that, once a delivery attempt has been made and the package has been deposited at your local postal service, the order is complete on our end. After this point, we can no longer track the package. If your local postal service ships it back to us, we cannot give you an estimated date of arrival since we no longer have eyes on it.


If you would like us to refund you for the products contained in the order that has been shipped back to us or if you would like us to resend the product once it arrives and you have paid for shipping, you are responsible for speaking to the appropriate individuals (your local postal service, USPS, customs, etc.) to track down the package and ensure it arrives safely at our facility.

 We are legally required to provide an unaltered purchase amount and invoice according to your countries import laws. Changing prices is illegal.


We do not ship batteries internationally! Any international orders we see with batteries will be canceled immediately. We are not responsible for any international battery orders.

To return international orders the customer will be required to purchase their own return label as we are unable to provide one. Items must be packaged appropriately for international shipping. Please purchase appropriate insurance on the parcel. We are not responsible for items damaged or lost in transit during the return process.


*IMPORTANT: We cannot guarantee that you will or will not be charged any customs taxes or duties. All customs forms will be accurate in value and contents of parcel. Any customs or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. This applies only to International orders.




Return and Refund Policy



Returns 


Unless stated otherwise, our return policy lasts 15 days. If 15 days have gone by since your purchase, unfortunately we can’t start a return. 


To be eligible for a return, the item must show a tracking scan within 15 days of the return being authorized or the return will be closed.


The item must be unused and in the same condition that you received it. It must also be in the original packaging. If you do not have the original packaging additional restocking fees may apply.


Please allow 7-10 business days for us to process your return. Business days are Monday-Friday.


All returns will have any restocking fees and shipping label costs deducted at the time of the refund.


Several types of goods are not eligible for returns, refunds, or replacements:


Any housings or mods that have been installed.


When purchasing modification kits or any other electrical equipment/components you are expected to have experience and knowledge with these systems. We are not responsible for any damage caused from misuse or negligence by the user.


All backlight mods are tested before they are sent out to you. When you receive a backlight kit, you should perform a bench test before installing to assure that nothing has been damaged in transit. A bench test means the kit is not installed in the shell, and no adhesive has been used. All ribbon cables should have no bends or creases in them. If you are unsure how to perform a bench test, please contact our support team and we will be happy to help. Backlight kits that have been installed are not eligible for replacement or return. If a backlight kit is returned and shows any signs of have been installed it may not be eligible for a refund.


When contacting our support team for help regarding any issue, you are required to provide any information, including photos, requested by our support team. If you refuse to provide the requested information then we will be unable to assist you.


If you cannot get your backlight kit working and believe it to be defective, we will issue a return label to you. When we receive the kit back we will diagnose the issue and replace any parts that may be needed and send it back to you. If we find the kit has been damaged or was not working due to user error additional fees may be required before we are able to return the kit to you.


Units with any of the following may be used as evidence of installation such as:


Protective film from LCD panels being removed and/or reapplied.


Creased, bent, or worn cables


Any sign of incorrect soldering


Any other damage that can occur from installing incorrectly.


We DO NOT offer refunds for defective items, we only offer exchanges. If you wish to return a defective item for a refund then the normal refund policies will apply. This includes the buyer being responsible for any return shipping or restocking fees. This is to avoid fraudulent returns, we appreciate your understanding.


If we determine the return is fraudulent a partial refund will be issued and you will be blocked from future purchases with us.


Additional non-returnable items: 


- Gift cards 

- Downloadable software products 


Please do not send your purchase back to the manufacturer. 


There are certain situations where only partial refunds are granted:

- Book with obvious signs of use 

- CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened 

- Any item not in its original condition, is damaged or missing parts for reasons not due to our error 

- Any item that is returned more than 30 days after delivery


Refunds (if applicable) 


Once we receive your return, please allow 5-7 business days for us to process the return. All returns are inspected and if approved, then your refund will be processed. All returns are subject to a 20% restocking fee. A credit will automatically be applied to your credit card or original method of payment, usually this takes 5-7 business days. 


All returns will have any restocking fees and shipping label costs deducted at the time of the refund.


Please note that if the payment provider does not refund payment fees, this amount will also be deducted from the total refund.


Defective items


If your item is defective or damaged you must contact us within 15 days of the delivery date or you will not be eligible for a replacement. 


We only offer exchanges on unused items if they are defective. If you have a defective item you will be able to receive an exchange only and not a return for a refund. If you want to return the defective item for a refund instead, normal refund policies will apply. You will be responsible for return shipping as well as any restocking fees. If you need to exchange it for the same item, send us an email at ezflashusa@gmail.com.


As stated above we DO NOT offer refunds for ANY defective items, we only offer exchanges. If you wish to return a defective item for a refund the normal refund policies will apply. This includes the buyer being responsible for any return shipping or restocking fees.


Depending on where you live, the time it may take for your exchanged product to reach you, may vary. 



Late or missing refunds (if applicable) 


If you haven’t received a refund yet, first check your bank account again. 

Then contact your credit card company, it may take some time before your refund is officially posted. 

Next contact your bank. There is often some processing time before a refund is posted.

ORDER CANCELLATIONS

Orders cannot be edited once placed. Please keep this in mind when placing an order as it is crucial you place your order with everything correctly:


Due to changes with the payment portal policies, credit card and PayPal fees are not being refunded for canceled orders. It doesn't matter if the order is canceled 5 minutes or 5 days after ordering. This is completely out of our control and we certainly do not agree with this policy. As a result however, you will be charged for this fee (about 5% of the total order value) if you decide to cancel your order so please be sure your order is correct before completing the checkout process.


If you would still like to cancel your order, orders may be eligible for cancellation before a shipping notification is issued. Please contact us via email at ezflashusa@gmail.com or by using the form on our website to see if your order can be canceled. 


 

Sale items (if applicable) 


Only regular priced items may be refunded, unfortunately sale items cannot be refunded. 


Important notice


PayPal has changed their refund policy in April of 2020 and are no longer refunding payment fees like they have in the past. Please note that when an order is refunded, the fee of 4.4% + $0.30 will not be refundable.


Shipping 


To return your product, contact us at ezflashusa@gmail.com. You will then use the prepaid return label we send to your email on file.


You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.


If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.


UPS is unable to deliver to PO Boxes. Please make sure your address is not a PO Box before checking out.
